Public Notice: Final Certification on Assessment Rolls

Public Hearings on Final Certification on Assessment Rolls to Impose the Uniform Method for Collection of Non-Ad Valorem Special Assessments

Notice is hereby given that the City Council for the City of Apopka will conduct a public hearing and subsequently adopt a resolution to Certify the Street Lighting and Neighborhood Improvement Non-Ad Valorem Final Assessment Roll for the imposition of annual non-ad valorem special assessments for the specified purposes on the dates and times as follows in the areas designated and specified herein.  Each individual non-ad valorem special assessment shall be billed on the Orange County Annual Tax Bill for the Fiscal Year beginning October 1, 2022, and annually thereafter for the collection of all associated costs and expenses applied to the designated areas as applicable.

The public hearing for Non-Ad Valorem Special Assessments shall be before the City Council of the City of Apopka in the Council Chambers at City Hall, 120 E. Main Street, Apopka, Florida, for the purpose of receiving public comment on the imposition of the assessments, as follows:

Florida Statutes (F.S.) require us to advise you that a failure to pay these special assessments will cause a tax certificate to the issued against the property which may result in the loss of title, F.S. 197.3632(4)(b). 

The non-ad valorem special assessments are for the reasonable and necessary costs and expenses associated with the services being provided. 

The Special Assessment Districts may only apply to the Designated District Areas, identified herein, where the City Council at the request of the developer intends to impose a special assessment for the purpose of providing developmental street lighting for the safety and welfare of the residents whom reside within the designated district area.  Neighborhood Improvement Districts are intended for the maintenance and upkeep of common areas of a development where the residents have allowed the Homeowners Association to fold and the common areas are no longer being maintained by the Homeowners and the City has to contract with independent vendors for the care and maintenance of these areas. 

The entire cost of the assessment shall be entirely apportioned to the property owners within the district receiving the benefited service.  The assessment will continue to be billed by the Orange County Tax Collector on the annual Orange County Tax Bill. 

All affected property owners have the right to appear at the public hearing and the right to file a written objection with the City Clerk’s Office within 20 days of the publication of this notice.  If a person decides to appeal any decision made by the City Council with respect to any matter considered at the hearing, such person will need a record of the proceedings and may need to ensure that a verbatim record is made, including the testimony and evidence upon which the appeal is to be made.  In accordance with the American with Disabilities Act, persons needing a special accommodation or an interpreter to participate in this proceeding should contact the City Clerk’s Office at 407-703-1794 at least three (3) days prior to the date of the hearing. 

The following tables designate the areas where the various non-ad valorem special assessments will apply and the annual assessment amount per parcel.

Copies of the Resolutions detailing the legal description of the areas to be assessed are available for inspection at the City Clerk’s Office in City Hall, located at 120 E. Main Street, Apopka Florida, between the hours of 8 AM and 5 PM, Monday through Friday.
